Terms and Conditions
Please read these booking terms and conditions carefully. By making a booking with The Sogunro Practice, you are confirming that you have read and agree to be bound by them. We may amend or vary these terms and conditions at any time and you should check this page periodically.

DEFINITIONS
“we”, “us” and “our” refers to The Sogunro Practice, also trading as Applied Pilates and Osteolates.
“you”, “your” and “client” means any individual, organisation or company whose order for services is accepted by The Sogunro Practice.
“services” means activities including, but not limited to, assessment, diagnosis of musculoskeletal issues, musculoskeletal therapy, exercise instruction and supervision, which The Sogunro Practice may provide in accordance with these Terms & Conditions.
“practitioner” means a person authorised to provide services for and on behalf of The Sogunro Practice.
“insured risks” means all the insured risks specified in the Malpractice and Professional Liability, Public Liability and Products Liability insurance policies, and for which The Sogunro Practice and its practitioners are insured under.

FEES
Details of fees charged for our services are provided on the Payment Options web-page.
Fees quoted are inclusive of VAT.
Specific fees to be charged will be agreed with you prior to provision of services.
Once paid for, fees are non-refundable.
Fees may be subject to change by us at any time before we accept your booking.
If you pay by standing order we aim to give you 6 weeks’ notice of fee changes.

BOOKINGS
Appointments and sessions are offered by us subject to availability.
For Small Group Sessions the booking is made for the service and not for a specified practitioner.
IF YOU NEED TO CHANGE YOUR BOOKING
Once paid for, fees are non-refundable, however you may re-schedule an appointment or session that you have booked, provided that you give us the required notice as follows:
– If you are unable to attend a booking, or you want to re-schedule your booking, we require at least 24 hours’ notice otherwise we will charge you at the full rate applicable to the relevant service
– Contact us by TEXT or EMAIL using the details provided on the Contact Us web-page
At our discretion it may be possible to transfer your booking to another family member provided that they meet any pre-requisites specified for the service required, and that it is used within the original expiry date.
IF WE NEED TO CHANGE YOUR BOOKING
In the event that we change an appointment or session that you have booked, we will contact you by email, text or telephone, giving as much notice as is reasonably possible for the circumstances.
We will offer you an appointment or session at an alternative date and time.
TIMES WHEN WE ARE CLOSED
We are closed all day on Sunday.
We close for Bank Holidays.
We close for two further floating weeks during the year – dates are notified as appropriate.

MEDICAL FITNESS
You are advised to consult your doctor prior to beginning exercise if you have concerns about your physical condition and wellbeing.
If you are over 69 years of age and are not used to being physically active, you are advised to consult your doctor before beginning a new exercise programme.
If you are between the ages of 15 and 69, are about to significantly change your physical activity level and you answer Yes to any of the following questions, you are advised to consult your doctor before beginning a new exercise programme:
Has your doctor ever said you have a heart condition and that you should only do physical activity recommended by a doctor?
1. Do you feel pain in your chest when you do physical activity?
2. In the past month, have you had a chest pain when you were not doing physical activity?
3. Do you lose your balance because of dizziness or do you ever lose consciousness?
4. Do you have a bone or joint problem (for example, back, knee, or hip) that could be made worse by a change in your physical activity?
5. Is your doctor currently prescribing medication for your blood pressure or heart condition?
6. Do you know of any other reason why you should not do physical activity?
7. Are you or do you suspect you may be pregnant?
You must inform us of any changes in medical or health status that may affect your treatment and or exercise session.
If you need to take time out of your exercise routine for a medical procedure we will require you to complete a Return to Exercise form on return to confirm that you have been signed off by your medical professional to resume exercise.
We reserve the right to refuse to serve any client if we consider that your health may contra-indicate use of the services. At our discretion we may refund a maximum of 50% of fees paid depending on the circumstances.

HYGIENE & COVID-19 SECURITY
We are committed to the maintenance of high hygiene standards and to safeguarding our clients and ourselves.
Please clean all equipment you have used during your session after use. Socks must be worn (preferably with non-slip soles) in the studio area; exercise in bare feet is not permitted.

SAFETY
You must observe the safety procedures that are specified for particular equipment and exercises as part of your instruction.
You must follow the instructions of the practitioner at all times; you are not permitted to instruct another client during sessions, or to take instructions from another client.
Never guess the setup for a piece of equipment, always check with the practitioner if unsure.
Some exercises are specified as requiring a high degree of concentration for safety reasons; any instruction to slow down, to reduce range and/or to refrain from talking during such exercises must be observed.
We reserve the right to refuse to serve any client if we consider that your behaviour may contra-indicate use of the services. At our discretion we may refund a maximum of 50% of fees paid depending on the circumstances.

GENERAL CONDUCT
Pilates exercises require concentration; in order for you to get the most out of your session we request that you keep social conversation to a minimum whilst engaging in your exercise sets.
Mobile phones can be used in the waiting room but cannot be used in the studio or treatment areas.

PARKING
Parking at the centre is not a guaranteed condition of our service. Parking is limited at the business centre and so we ask that clients observe the following in consideration of other clients sharing the facilities, particularly within the period Mon-Fri 9am to 1pm.
Clients may only park in the spaces marked Unit 5 or in the general visitor parking in front of the main reception, otherwise you are requested to park on the roadside.
When parking within the business centre please ensure that your car is parked within a single bay.
When your session is completed please be timely in moving your car so that the next clients have somewhere to park.
If you decide to visit the local retailers please do not leave your car parked at the business centre.

PERSONAL BELONGINGS
Personal belongings are brought onto the premises at your own risk and we do not accept liability for any loss or damage whatsoever to such items, whether within or outside the immediate treatment and exercise area.

PRIVACY POLICY
In the course of providing you with our services we collect and process personal information.
Our Privacy Policy describes how we collect, use, share, retain and safeguard your personal data.

Information published on this web-site is provided for the use of clients and visitors and the information will be altered and updated from time to time.
Although care has been taken to ensure technical and factual accuracy, errors may occur.
We have no liability arising from the use of the information on this web-site.
No warranty is given that the web-site content including hyperlinks are virus free or uncontaminated, it is the responsibility of users to carry out their own virus checks and we exclude all liability for contamination or damage caused by any virus or electronic transmission.
The intellectual property rights for our web-site content and for the Sogunro, Applied Pilates and Osteolates brands, trade-marks and logos are owned by us. You are not permitted to make any copies of any part of the content, brand, trade-marks or logos without our written permission and without exception we will take action against any occurrences which we become aware of.

LIMITATION OF LIABILITY
We cannot be held responsible for any particular session, treatment, practitioner and/or item of equipment not being available for whatever reason. We reserve the right to make alterations to the sessions, instructors and/or equipment provided, without notice and will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.
Our services are provided on the basis of, and in strict reliance upon, all material facts and information having been accurately disclosed to us by you. We shall not be liable for any loss or damage arising from you failing to disclose such facts and information.
You accept the risk of injury from performing exercise and using specialist equipment and you are advised to consult your doctor prior to beginning any session if you have concerns about your physical condition and wellbeing.
You must strictly follow the instructions of the practitioner at all times, and we cannot be held responsible for any injury arising or being made worse by your failure to do so.
Except in respect of death or personal injury caused by our negligence, our total liability for any one claim (being an insured risk) or for the total of all claims arising from one act or default shall not exceed £5,000,000 (or other such sum for which the insured risks are specified).

FORCE MAJEURE
We make every effort to provide a prompt and efficient service but we shall not be liable to our clients, or in breach of contract, where we are prevented from performing or are delayed in performing any of our services under these terms and conditions by any cause beyond our reasonable control, including, but not limited to, Acts of God, explosion, flood, tempest, fire or accident, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes, IT viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.

ENGLISH LAW
These Terms & Conditions are subject to English Law and the exclusive jurisdiction of the courts of England and Wales.
